SmallBizGuides.com Publishing Agreement

This Agreement is between SmallBizGuides.com, the Publisher and the Author)(s) of The Work.  The Author(s) is (are) submitting their work with the understanding that this Agreement applies ONLY to The Work, and not to any other products of The Author(s) or The Publisher.

The Author(s) certifies that The Work submitted is solely The Author’s (s’) and does not infringe on any copyright, trademark, license or any other legal rights to The Work.  The Author(s) agrees to hold The Publisher harmless and defend The Publisher from any action brought against The Publisher from any source, in any country, for any reason related to The Work. 

The Author(s) gives the Publisher the right to reproduce The Work electronically, and publish it for sale on the Publisher’s website. The Publisher reserves all rights in terms of how The Work is published on the Publisher’s website for the term of this Agreement.

The Publisher will make The Work available for purchase by the general public for a fee specified by the Author(s).  The Author(s) agree to set a purchase price based on market rates and the Publisher’s minimum product price of $5.95. The Author(s) will receive sixty per cent (60%) of the total sales price received for any purchases of The Work, excluding taxes, payable monthly, 15 days following the close of every calendar month. Checks are drawn on a U.S. bank and payable in U.S. dollars.

The Publisher will provide The Author(s) with a web page for review of published materials, and a monthly report of totals of sales of The Work for the length of the Agreement.

The Publisher will not be held liable for failures of the electronic media, web sites, web pages, browsers, or any portions of any networks.  The Publisher will only be responsible for payment to The Author(s) for money The Publisher actually receives as a result of publishing The Work.

The Publisher does not require the Author(s) to sign a contract in order to publish The Work on the Publisher’s website. The Publisher will never require exclusive rights to the Author(s) Work. The Author(s)will always retain all rights to The Work. The Author(s) retains the right to sell The Work with other websites or publishers. The Publisher or Author(s) may discontinue the sale of The Work by notifying the other party 30-day in advance of discontinuing the agreement.
